Profile
Jeff Herman helps hospitals, health systems and other health care providers and organizations with contracts, fraud and abuse, prohibitions on self-referrals, medical staff bylaws, hospital policies and procedures, mergers and acquisitions, and other matters. He received his Health Law Certificate from the St. Louis University School of Law in 2010. Jeff also helps employers of all kinds design, draft, administer and defend their employee benefit plans.
His experience includes matters involving:
- Anti-Kickback Statute, Stark Law and Civil Monetary Penalties Law
- 340B Drug Pricing Program
- HIPAA, as well as substance use disorder confidentiality requirements under 42 CFR Part 2
- Qualified plans, including 401(k) plans
- 403(b) plans
- Employee stock ownership plans (ESOPs)
- Nonqualified deferred compensation plans under Code Sections 409A, 457(b) and 457(f)
- Severance plans
- Non-ERISA plans, such as church plans and governmental plans
- Health and welfare plans, such as disability, life, medical, vision and dental coverage
- HSAs, FSAs, and HRAs
- Multiemployer and multiple employer plans (including Association Health Plans)
Jeff also helps construction companies and other businesses navigate the pitfalls of multiemployer pension plan withdrawal liability.
Jeff has written frequently on health law and employee benefits topics for several publications, including the Food & Drug Law Journal, the Saint Louis University Journal of Health Law & Policy, the ABA Journal of Labor & Employment Law, and the Journal of the Missouri Bar. Prior to joining Greensfelder, Jeff represented clients seeking benefits under ERISA, giving him a unique perspective on benefits issues affecting employers, and he was also a Health Policy Fellow for the Missouri Foundation for Health.
