Health Care Class Action Pertaining to Billing Practices

The plaintiff sought to represent a class of patients with out-of-network insurance who were billed the balance of hospital charges that were not covered by out-of-network insurance. In other words, the plaintiff contended that our client, a hospital system, must accept as payment in full whatever amount is paid by a patient’s out-of-network insurance company. The plaintiff claimed our client’s alleged practice of “balance billing” violates Missouri’s Merchandising Practices Act.

Motion for summary judgment was granted in May 2014, and plaintiff’s motion to reconsider was denied in September 2014.
