Transportation & Logistics

Your business structure can help you avoid liability. What are you doing about it? Proactive counseling - in addition to representation when things go wrong - frames the core of our work for transportation clients. Let us go to work for you.

The sophistication of your business and the transportation industry more generally has changed dramatically over the years. Your legal representation should not only be there to help you through accidents or claims, but also be there early, providing proactive advice to help avoid problems before they occur.

We represent national carriers, logistics companies, truck leasing companies, and distributors in all phases of transport and distribution, with a focus in two primary areas:

  • Client representation in response to accidents and liability issues
  • Proactive and holistic counseling regarding organizational structure, contracts, insurance, and other agreements in pursuit of future claim avoidance

Claim Representation
We provide long-term strategic planning, defense of claims, and regulatory expertise for our clients, utilizing the most advanced technology and leveraging key industry contacts. For our motor carrier clients, we are ready to quickly respond and assess an accident scene with our 24-hour Motor Carrier Emergency Response Team (M-CERT). We can counsel you through:

  • Accidents
  • Catastrophic losses and catastrophic death claims
  • Freight claims
  • Governmental relations and regulatory compliance
  • Litigation
  • Product liability claims

Proactive Counseling
We can partner with you to provide a holistic review and forward-looking approach to your business operations, reducing your risk and potential for future liability. Beginning with an audit, we will address each of the following, making recommendations along the way:

  • Contract review and organizational structure audit with an eye toward increasing entity protections
  • Insurance coverage audit to insure that adequate protections are in place in the event of a catastrophic claim relating to leasing or transport
  • Incident reports and/or Department of Transportation audits
  • Customer relationship review, identifying any potential issues with customers and reviewing agreements for liability shifting provisions, maximum protections, and insuring all agreements are up-to-date and comply with current law

Following the audit, we will make recommendations as to implementation and can assist with any necessary onsite training or additional auditing to help minimize exposure to liability. Our ongoing corporate representation for transportation clients typically covers the following areas:

  • Corporate and organizational matters including mergers and acquisitions, contracts
  • Employment matters
  • Environmental regulations and practices
  • Governmental relations and regulatory compliance
  • Intellectual property
  • Labor negotiations
