Prenuptial and Postnuptial Agreements

Prenuptial agreements are frequently used by couples planning to marry, as a way of determining, prior to the marriage, their respective rights and responsibilities in each other’s estates in the event of death or divorce. Ideally, discussion and implementation of such agreements reduces, rather than increases, the likelihood that there will be any future disagreement that might affect the marriage. Such agreements can also be used as a way of safeguarding assets for an individual’s family, in the event of a second marriage. Typically, these agreements are done prior to the marriage (a "prenuptial" or "antenuptial" agreement), but they can also be entered into after the marriage (a "postnuptial" agreement).
