News: Congratulations to David Harris and Sandra Gallini on defeating an application for TRO and preliminary injunction filed by franchisees operating over 100 Southern California gas stations in the United States District Court for the Southern District of California, as well as Emergency Motions for Injunction to the Ninth Circuit. The franchisees invoked the Petroleum Marketing Practices Act in an attempt to prevent a major integrated refiner from terminating and nonrenewing the franchisees' station leases and fuel supply agreements at the expiration of underlying ground leases held by a third party for the properties. The Greensfelder team served as lead counsel for the principal Defendant, a major integrated refiner. John briefed and argued an appeal to the United States Court of Appeals for the Fourth Circuit, which reversed a district court judgment and held that a brand covenant in the real property deed to a gas station was valid and enforceable. The same restriction was used in deeds to more than one hundred stations in Virginia and is thus a critical safeguard of the client's distribution model in that geography.
