Mr. Menghini is an Officer in the Construction Practice Group, and has spent his entire career practicing solely construction law. Mr. Menghini’s practice includes the representation of clients in a wide variety of transactional and claim-related issues and disputes in the construction arena. Mr. Menghini has handled single and multi-party matters at the state, federal, appellate and bankruptcy court levels, as well as in private arbitrations.

 

Mr. Menghini’s claim-related practice includes the preparation and defense of claims ranging over a variety of construction-related areas, including but not limited to delay, acceleration, disruption/inefficiency, defective design, bid disputes, contract default, improper workmanship, payment and performance bonds and mechanic’s liens.

Mr. Menghini has lectured and authored articles on many different construction topics, including mechanic’s lien and surety law, construction payment issues and construction contracting. Further, Mr. Menghini is active in local and national construction law memberships, including the American Bar Association Forum Committee on the Construction Industry and the Bar Association of Metropolitan St. Louis Construction Group

Representative Cases

  • Light Rail Construction.  Represented collaborative of design and construction management firms in the successful defense of a $100 Million claim brought by the project owner arising out of the construction of an eight mile extension of the MetroLink line in St. Louis, Missouri.  (Litigation:  Jury Verdict)
  • Cement Plant Construction. Represented owner in the defense of a $15 Million cost overrun claim arising out of the construction of a granulated slag processing plant in East Chicago, IN. (Arbitration)
  • High Rise Condominiums. Represented mechanical subcontractor in the defense of defective work claims in excess of $2 Million arising out of the construction of a luxury condominium tower in St. Louis, Missouri. (Arbitration)
  • School Construction. Represented general contractor in the defense of subcontractor’s wrongful termination claim arising out of the construction of a high school. (Arbitration)
  • Road Construction. Represented a number of general contractors in the prosecution of delay and inefficiency claims arising out of the construction of several roadways in St. Louis, Missouri. (Litigation)
  • Nursing Home Construction. Represented general contractor in prosecution of claim for breach of contract against owner arising out of the construction of a nursing home facility in St. Louis, Missouri. (Arbitration)
  • Hotel Construction. Represented a number of general contractors in prosecution and defense of claims for breach of contract against owners arising out of the construction of several hotels in the St. Louis, Missouri area. (Litigation)
  • Condominium Construction. Represented a number of general contractors in prosecution and defense of claims for breach of contract against owners in several matters arising out of the construction of several large condominium complexes in the St. Louis, Missouri area. (Litigation and Arbitration)
  • Tunnel Construction. Represented tunneling contractor on various claims arising out of several tunnel projects throughout the United States.
  • Sewer Rehabilitation.  Represented sewer rehabilitation contractor in dozens of disputes throughout the United States.
  • Jail  & Courthouse Construction. Represented construction manager in connection with claims arising out of the construction of a detention center and justice center in Las Vegas, Nevada.
  • Bankruptcies. Represented several contractors in the prosecution and recovery of claims in excess of $2.5 Million in the Bridge Information Systems, Inc. bankruptcy. Represented several contractors in connection with collecting debts in various bankruptcies.
  • Bid Disputes.  Successful representation of general contractors in various bid disputes across the United States.
