Jim Ferrick is an Officer who represents clients in the areas of litigation, corporate counseling, and health care compliance. Mr. Ferrick’s experience as both litigator and corporate lawyer allow him to offer unique insight into both the legal and business risks associated with your company.
In the litigation arena, Mr. Ferrick focuses his practice in the areas of commercial litigation, class actions, and product liability. He has successfully represented clients as lead counsel in trials, arbitrations and appeals in both state and federal courts. He has extensive experience in some of the country’s most challenging venues, including St. Louis, Missouri and Madison and St. Clair counties in Illinois.
Mr. Ferrick has defended class actions in both state and federal courts around the country. He has handled class actions involving financial services and securities, consumer products, insurance coverage and tax issues. He has handled all stages of class action defense, including class certification, dispositive motions, expert discovery, and settlement administration.
Mr. Ferrick represents clients in a variety of commercial cases including breach of contract actions, insurance coverage matters, distributor termination disputes, breach of warranty and other Uniform Commercial Code cases, fraud actions, and other complex business disputes.
He has substantial experience in handling trust disputes on behalf of both beneficiaries and fiduciaries. He also has experience in franchisor/franchisee relationships, indemnification and insurance coverage issues, and equipment financing and leasing.
In the product liability arena, he has represented manufacturers and distributors in litigation involving the design and manufacture of a wide variety of products, including construction equipment, chemicals, truck and auto parts, tractors, high lifts, machine presses, printing presses, underground mining equipment, boats, farm implements, and other types of equipment.
He has substantial experience in the pharmacy benefit management industry acting as outside counsel for a PBM. He assists clients in many other aspects of the health care field, including HIPAA compliance, employment contracts, medical malpractice issues, Medicare payment and billing problems, and product liability exposure.
Mr. Ferrick also regularly counsels clients on all aspects of business operation and planning. He advises businesses regarding formation/start-up issues, shareholder, partnership and LLC operating agreements, non-competition covenants, employment agreements, succession planning, real estate acquisitions, and buy/sell agreements.
