Insurance Coverage & Litigation
Greensfelder’s insurance litigators are experienced in representing carriers and policyholders across a wide range of insurance disputes. Our attorneys are skilled in advising and advocating for clients during all aspects of the claim process including investigation, policy interpretation, claim evaluation, and any ensuing litigation. Our team of insurance lawyers knows how to assess the parties’ respective obligations under all applicable policies and counsel clients regarding the implications of the pertinent coverage forms, exclusions and endorsements. Greensfelder attorneys represent clients in state and federal courts in breach of contract claims, declaratory judgments, interpleaders, equitable garnishment actions, and lawsuits seeking extra-contractual and exemplary damages over and above the limits of the applicable policies. The types of claims in which our attorneys have represented parties include, but are not limited to, those brought under automobile (commercial, fleet, and individual), commercial property, commercial general liability, environmental, business interruption, director and officer, errors and omissions, and medical liability policies.
Our attorneys possess the skill and knowledge necessary to provide opinions related to coverage and to navigate the variety of issues that frequently arise in complex insurance litigation. We have represented parties in claims and lawsuits involving multiple carriers, policies of primary and excess coverage, requests for information from state insurance authorities, and allegations of bad faith or vexatious refusal to defend. In addition to our team of insurance attorneys, we can draw from the wide ranging expertise of all of Greensfelder’s practice groups to evaluate the most sophisticated claims such as environmental, intellectual property, or data privacy.
In addition, our attorneys have experience in the pre-suit investigation of insurance claims. We have taken sworn examinations of insureds following the submission of a claim, advised on the retention of experts, conducted witness interviews, evaluated documents submitted in support of claims, prepared coverage opinions, and assisted in authoring final coverage determinations. In the event a claim is paid, we can provide advice and representation regarding potential avenues for recovery, including subrogation and contribution from other carriers.
