First Amendment & Media Litigation
Greensfelder has successfully represented a variety of media organizations, businesses, advertising firms and individuals in disputes involving issues of defamation, commercial disparagement, invasion of privacy, access to publicly available information, and intellectual property rights. We bring a valuable perspective to these disputes, in that some of our attorneys are former journalists with a unique appreciation of the practical issues faced by print and electronic media outlets. This is particularly true when our attorneys perform pre-publication review and measure the risk of possible litigation against the importance of getting a complete, fair and accurate report. In handling such disputes, we have developed vast experience in First Amendment issues generally, and as they relate to media and advertising issues in particular.
We also work closely with our Constitutional Law Practice Group to successfully prosecute direct First Amendment challenges to federal, state and local restrictions on political or commercial speech. In all of these instances, our expertise allows us to navigate the First Amendment issues presented in prosecuting or defending such claims, and often avoid litigation altogether.
