Debtor / Creditor Rights & Remedies
Greensfelder’s Bankruptcy & Creditors’ Rights Practice Group not only represent individual and corporate debtors in developing strategic plans of reorganization from a business and operational perspective, but also represent secured creditors such as mechanic’s lien claimants and lending institutions to protect their rights during the bankruptcy case process. Our attorneys also have extensive experience representing bankruptcy trustees and unsecured creditor committees. Members of our Practice Group regularly deal with a wide array of bankruptcy and nonbankruptcy issues such as assignments for the benefit of creditors, issues arising under the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, the Uniform Commercial Code and the WARN Act.
We regularly assist our clients in recovering value from debtors pursuant to judicial and non-judicial foreclosures on real estate, foreclosure on security interests in tangible and intangible personal property, and through the enforcement of judgment liens.
