Greensfelder has an experienced group of attorneys who provide advice, counsel and litigation services to clients on a wide array of constitutional issues arising under the federal and state constitutions.
Members of the Practice Group have substantial experience interpreting, analyzing and litigating constitutional issues and in challenging the constitutionality of local, state, and federal laws, facially or as applied. Our experience includes representing clients in significant matters arising under the First, Fourth, Fifth, Sixth, Eighth, Tenth, Eleventh and Fourteenth Amendments that involve issues ranging from freedom of speech, press, religion and assembly, to substantive and procedural due process, sovereign and qualified immunity, and takings and land use. Our members also assist clients with constitutional challenges to state law under the Dormant Commerce Clause, the Equal Protection Clause and the Supremacy Clause, and constitutional defenses to punitive damages and class action damages.
Members of the Practice Group work closely with the Firm’s First Amendment and Media Litigation Practice Groups and have substantial experience representing media clients in connection with a range of industry specific constitutional issues, including privacy, access to information, grand jury proceedings, protection of sources and unpublished information, and constitutional defenses to defamation and other related claims. Our members also work closely with the Appellate Litigation Practice Group in matters involving important constitutional issues and are sensitive to state and federal court comity issues such abstention.
Our attorneys practice before state and federal trial and appellate courts throughout the country, including the Supreme Court of the United States.
