Mr. Vantine is an Associate in the Construction Practice Group. He represents a wide variety of clients in a claims-related and transactional practice in the construction industry. Mr. Vantine has handled complex issue and multiple party litigation at the state, federal and appellate level, as well as in the alternative dispute resolution forum. Mr. Vantine’s clients have included general contractors, subcontractors, sureties, design professionals and project owners.

Mr. Vantine has experience in prosecuting and defending significant construction disputes, including but not limited to mechanic’s liens, schedule/delay claims, contract default claims, improper workmanship claims, error and omission claims against design professionals, payment and performance bond claims, and UCC claims.

Mr. Vantine also has experience in the pre-construction transactional phase of project. He has experience in traditional design-bid-build construction contracts, design-build contracts, construction management contracts and other contractual arrangements on multi-million dollar projects.

Mr. Vantine has first hand trial experience as well as appellate experience and has argued before the Missouri Court of Appeals, Southern District.

Cases

  • Abhe & Svoboda, Inc. et al., v. Brighton Painting Company, et al., United States District Court for the Eastern District of Kentucky, Civil File NO. 5:05-486. Negotiated 12 million dollar settlement arising out of an action involving the painting of a Kentucky bridge and termination of the contractor.
  • CBD Enterprises, Inc. v. Braco Manufacturing, Inc., 181 S.W.3d 129 (Mo.App.S.D. 2005). Wrote and argued prevailing appellate briefs in breach of contract case in which default judgment was entered against Braco Manufacturing. Ruling overturned on appeal. Missouri Lawyer’s Weekly cited as a significant decision in 2006.
  • R.G. Brinkmann Co. d/b/a Brinkmann Constructors v. Westport Flooring, Inc., St. Louis County, Missouri Circuit Court Case No.: 06CC-003649. Prosecution of breach of contract claim due to the default of subcontractor on the project causing additional cost to the prime contractor.
  • UCC – Represented manufacturer of goods in product defect/warranty claims and breach of contract case arising out of the use of goods as siding on an apartment complex project in St. Louis County, Missouri.
  • Loft Project – Represented project owner in defending breach of contract and lien claims by a subcontractor arising from the default of the general contractor for its failure to make payments to subcontractors.
  • Payment Bond – Represented subcontractor in Miller Act payment bond claim against general contractor and surety arising out of the public entity’s failure to make payment for changes in the scope of the work and the contractor’s default and termination.
  • Performance Bond – Represented surety in performance bond claims made against surety by public owner due to default of contractor wherein contractor was terminated due to delays.
  • Missouri Mechanic’s Lien – Represented subcontractor in mechanic’s lien claims against property owner and general contractor wherein the general contractor defaulted on payments to subcontractor.
  • Illinois Mechanic’s Lien – Represented direct contractor in mechanic’s lien/breach of contract action in which the project owner defaulted on payments to both the contractor and the bank and the property was foreclosed upon by the bank.
