Greensfelder has an experienced group of attorneys who have substantial experience in appellate litigation. These attorneys prepare appellate records, draft appellate briefs and deliver oral argument before state and federal courts in a variety of jurisdictions. They also assist the firm’s trial lawyers in complex cases involving pre-trial, trial and post-trial motion practice requiring intensive research and writing skills.
The Firm provides to its clients a team approach, which combines the skills of the trial and appellate lawyers, especially in larger cases involving significant financial exposure or important legal issues. For example, members of the appellate practice group assist the Firm’s trial lawyers in analyzing affirmative defenses and legal strategic issues, preparing motions to decertify a putative class, motions to dismiss, motions for summary judgment, interlocutory appeals and writs of mandamus and prohibition, motions in limine, jury instructions, post-trial motions and supporting memoranda of law. They also perform the critical function of assisting the Firm’s trial lawyers in identifying substantial legal issues and preserving those issues for appellate review.
Individual members of the Appellate Litigation Practice Group also practice in particular substantive law areas such as commercial, products liability, antitrust and constitutional litigation and serve as appellate liaisons with the lawyers who practice in these areas.
Members of the practice group follow substantive law developments in the state and federal courts. They are sensitive to procedural issues such as removal, personal jurisdiction, subject matter jurisdiction, and abstention. The lawyers in the group also monitor judicial trends and changes in procedural rules in state and federal jurisdictions.
The Firm’s home office in St. Louis, Missouri, serves as a base for its representation in all Missouri Courts of Appeal as well as in the Supreme Court of Missouri. The Group’s appellate lawyers also practice before the U.S. Court of Appeals for the Eighth Circuit, which is based in St. Louis. In addition, the Appellate Litigation Practice Group’s lawyers have substantial experience in the Illinois appellate courts, particularly in southern Illinois, where the firm has a substantial office and practice. The Group’s lawyers also practice in the Supreme Court of Illinois, the U.S. Court of Appeals for the Seventh Circuit, which is based in Chicago, the Supreme Court of the United States, and other state and federal appellate courts across the country.
